b. Portfolios & User-Uploaded Content
Storage & Deletion: Content is stored securely and deleted upon account closure or on request, unless subject to institutional data agreements or audit obligations.
Privacy & Access: Your content is visible only to you, unless shared with your institution, coach, or a designated reviewer.
Responsibility: You must ensure uploaded content does not include student data or third-party information without appropriate consent. EduSpark is not liable for unauthorised disclosures from user-uploaded files.

Device identifiers, geolocation data
Usage data (course access, progress, completion history)

How We Use Your Information
We process personal data to:
Create and manage your user account
Provide access to courses, certificates, and learning tools
Monitor engagement and improve platform features
Send updates, reminders, and service-related communications
Provide customer support and resolve disputes
Comply with legal obligations
Enable course creators to communicate with enrolled learners via EduSpark regarding course content, updates, or other relevant offerings – only if you have explicitly opted in. All such messages are sent solely through the platform; your contact details are never shared externally.
Analyse aggregated, anonymised data for research and platform improvement
Legal Basis for Processing (EEA & UK Residents)
We rely on the following legal bases:

Legitimate interests (such as improving and securing the platform, fraud prevention)

Course Creator Communications
With your explicit, separate consent, course creators may communicate with you regarding your enrolled courses and, if you choose, provide updates about other course offerings from that creator.
All such communications occur only within the EduSpark platform; your email address or contact details will never be given, exported, or disclosed to creators for their own direct use.
Course creators are contractually prohibited from copying or exporting learner contact details.
You can update or withdraw your consent at any time via your account settings.
Consent for course communications is separate from any consent to receive promotional or marketing messages.
All consents and communication logs are retained for audit and compliance while your account is active, and for a limited period thereafter (typically 12 months).
Data Retention
We retain your data only as long as necessary to:
Fulfill the purposes described in this policy
Comply with legal obligations
Resolve disputes and enforce our agreements
Inactive accounts may be anonymised or deleted after a reasonable retention period. Communication logs and consent records are retained while your account is active and typically for 12 months after account closure.
Security Measures
We use industry-standard security protocols, including encryption, access controls, and ongoing monitoring, to protect your data. No method of transmitting or storing information is completely secure, but we regularly review and update our safeguards.
Breach Notification:
If we discover a data breach that may affect your data, we will notify you promptly, along with our remediation steps.

If your information is transferred outside your jurisdiction (for example, to servers in the US or EU), we ensure an adequate level of data protection as required by applicable law (including EU Standard Contractual Clauses for transfers from the EEA/UK).

Academic Integrity & Platform Misuse
EduSpark maintains a zero-tolerance policy regarding academic dishonesty or misuse of the system. We monitor user activity to uphold standards. If unusual usage is detected (e.g., rapid course completions without engagement), we may:
Temporarily suspend or restrict your account
Revoke certificates earned through misconduct
Delete illegitimate course progress
Ban or delete your account permanently
Report misuse to a learning leader or institution
You may appeal within 7 days, and we will review cases fairly and transparently.
Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be announced via email or posted on the platform. Continued use of the Services after such changes indicates your acceptance.
